Violations

Uber’s practice of charging a fixed cancellation fee of $5.75 for Uber rides violates regulations requiring charges to be based on the actual cost of the service. Additionally, Uber’s Terms and Conditions fail to specify the amount of the cancellation fee, leading to a lack of clear and transparent information about the charges imposed on consumers.

Proposed Class

All persons in Quebec who, after cancelling their Uber (or after Uber initiated the cancellation): (i) paid a stipulated fixed amount of charges, penalties or damages to Uber, contrary to section 13 CPA; or (i) were charged costs by Uber that were not precisely indicated in the contract contrary to sections 12 and 219 CPA.

Remedies sought for consumers

The purpose of this class action is to obtain, notably:

  1. an injunction ordering Uber to cease charging consumers for cancelling an Uber Ride or an Uber Eats order;
  2. compensatory damages or reimbursement of fees illegally collected by Uber; and
  3. punitive damages for Class Members.
