Violations
Plaintiff alleges that the cancellation fees of $5.75 and $6.90 imposed by Uber for cancelled rides are illegal and in violation of Quebec’s Consumer Protection Act. Plaintiff further alleges that cancellation fees imposed by Uber for cancelled Uber Eats orders are equally illegal. By Judgment rendered on February 13, 2025 (accessible below), the Court authorized this class action against Uber.
The Class Definition
All persons in Quebec who, from September 6, 2019, after cancelling their Uber Ride or Uber Eats (or after Uber initiated the cancellation) were charged any amounts by Uber that were not precisely indicated in the contract.
Remedies sought for consumers
The purpose of this class action is to obtain, notably:
a) an injunction ordering Uber to cease charging consumers for cancelling an Uber Ride or an Uber Eats order;
b) compensatory damages or reimbursement of fees illegally collected by Uber; and
c) punitive damages for Class Members.
